ORGANIC BRAZILIAN LEGISLATION

The Administrative Orders submitting the Regulatory Instructions for the Regulation of the Organic Sector in Brazil to public consultation have already been published.

The Regulatory Instructions (RIs) that complete the regulation of Law 10831/2003, known as the Organic Agriculture Law, are already in public consultation for a period of 30 days, a term that was agreed upon within the Organic Agriculture Sector Chamber (Câmara Setorial de Agricultura Orgânica – CSAO).

We can say that this is one of the victories in a long process, starting with the first alternative product fairs of the seventies and up to the drawing up of these RIs.

 

From the time the Law was signed, on December 23, 2003, a participative process started, with dozens of meetings and virtual work-groups, and hundreds of collaborators, from the most diverse sectors. There have been almost 4 years of discussions, always with the support of the CSAO, in which the consensus was always sought, without the need to vote on decisions.

The objective of the present public consultation is to allow for broad publicizing of the
proposed Regulatory Instructions, in order to receive suggestions from interested bodies, entities or persons. Such suggestions will be evaluated and organized by a Work Group composed of six members: four belonging to the organic production chain, nominated by the CSAO, and two from the Agro-ecology Coordination Department of the Ministry of Agriculture.

Once the work is concluded by the Work Group, the proposed texts will be submitted to the Organic Agriculture Sector Chamber for their consideration, and then, after legal analysis by the Federal Government’s Solicitor-General, they will be sent for publication

Lawyer Sérgio Carrano emphasized the importance of the participation of those interested in the organic sector: "It is of great importance that consumers, producers, associations, processors, traders, the industry and the storeowners get acquainted with the content of the technical text introduced above, because its provisions will affect everything from the cultivation to the sale of organic products in the country, and all the agents in the chain will have to adapt to these regulations”.

In the last week of May 2008, the Brazilian Ministry of Agriculture promoted the Organic Food Week, when several States of Brazil  promoted initiatives to disseminate the importance of organic agriculture for health and for the environment.
